Image
The Supreme Court asked the centre and states to ensure the practice is stopped. New Delhi: The Supreme Court today slammed the use of the "two-finger test" in cases of rape and sexual assault and asked the centre to ensure the practice is stopped. The practice has no scientific basis to ascertain the sexual history of women, and it instead re-traumatises them, the Supreme Court said as it ruled that any individual conducting the "two-finger test" on a survivor will be held guilty of misconduct. "It is patriarchal and sexist to suggest that a woman cannot be believed when she states that she was raped merely because she is sexually active," the top court said.  A Supreme Court bench comprising Justice D Y Chandrachud and Justice Hima Kohli made these observations while restoring conviction in a rape case.  The bench overturned a Jharkhand High Court's ruling acquitting a rape and murder convict, and upheld a decision of a trial court holding ...

Est-ce suffisant ? Tous pointent une situation « critique ». Read the full article here

To make matters worse, Pace said he and his family were told by his insurance company that there were no hospital beds available in Toronto or Mississauga to treat his mother. After weeks of waiting, Pace said his insurance company presented him with an unusual option: his mother would be flown back to Toronto anyway and dropped at a local emergency room. “It is stressful,” Pace told CTV News. “It’s created a lot of anxiety for the family abroad.” Carmen Pace is transported by airplane to a St. Joseph's hospital in Toronto. Supreme Court strikes down law requiring sex offenders to be automatically added to registry - CBC News

The Supreme Court of Canada has ruled that a 2011 change to the Criminal Code requiring sex offenders to automatically be added to the sex offenders registry is unconstitutional. In a five to four split, the top court ruled that anyone who has been added to the National Sex Offender Registry since 2011 can apply to have their status changed.  Former Conservative prime minister Stephen Harper's 2011 changes to the Criminal Code required sex offenders' names to be automatically added to the registry. Anyone convicted of two sex offences or more remains on the registry for life. The changes meant judges no longer had the discretion to submit the names of sex offenders to the registry.  Prior to the 2011 change, a Crown prosecutor had to apply for a Sex Offender Information Registration Act (SOIRA) order and ask a judge to decide whether the offender should be added to the sex offender registry. The court considering the order would have to determine ...

Meteorologist Robert Grove of the Gander Weather Office says Thursday was unseasonably warm. Thirteen records were broken and one was tied. St. John’s was the hot spot at 21.6, an all-time record by far, and Millertown-Buchans tied their record high for October 27. Finished with max 21.6°C on this last day of our warm spell. At home ministry's Chintan Shivir, PM Modi bats for 'One Nation, One Uniform' for police - The Indian Express

Prime Minister Narendra Modi , while addressing the first Chintan Shivir (brainstorming session) of state home ministers and top police officers, pitched the idea of a single uniform for police forces across the country on Friday. “The ‘One Nation, One Uniform’ for police is just an idea. I am not trying to impose it on you. Just give it a thought. It may happen, it may happen in 5, 50 or 100 years. All the states should just think it over,” the prime minister said, adding that he believed the identity of police across the country should be the same. “There is one important issue for our nation. Currently in our country, there is a ‘one nation, one ration’ card; ‘one nation, one mobility’ card; ‘one nation, one grid’ and a ‘one nation, one sign language’. Just like this, all the states should think of a ‘one nation, one uniform’ policy. It will also provide profit and also will give a common identity to law enforcement as citizens will recognise police personnel anywhere in the coun...
